What is the Partner Visa :Subclass 820 and 801 ?

The Partner Visa is for people who are married to or in a de facto relationship with an eligible Australian partner. It is processed in two stages:

Subclass 820 is the temporary visa that lets you stay lawfully in Australia until your permanent visa is being assessed. This visa allows you to live, work and study in Australia while building your future with your partner. In most circumstances, applicants holding a Subclass 820 Temporary Partner Visa are also eligible to access Medicare, similar to those on a Bridging Visa A. After maintaining the Subclass 820 visa for a period of two years, you may become eligible to transition to the Subclass 801 Permanent Partner Visa, subject to meeting the relevant criteria.

Subclass 801 is the permanent visa that may be granted after you have held the 820 visa for at least 24 months, provided you continue to meet the eligibility requirements. The Subclass 801 Permanent Partner Visa permits eligible spouses or de facto partners to reside in Australia on a permanent basis. Upon grant of this visa, applicants may become eligible to apply for Australian citizenship and are entitled to the full range of benefits and privileges afforded to permanent residents.

To apply for a Partner Visa (Subclass 820 and 801), you must meet the following requirements under Australian migration law:

 

For Subclass 820 (Temporary Partner Visa)

  • You must be in Australia at the time you apply and when a decision is made.
  • You must be in a genuine and ongoing relationship with your partner, who must be an Australian citizen, permanent resident, or eligible New Zealand citizen.
  • Your partner must be your spouse (legally married) or de facto partner (in a relationship for at least 12 months, or meet criteria for a waiver).
  • You must have sufficient evidence to prove the authenticity of your relationship.
  • You must have an eligible sponsor who is not barred from sponsoring a partner.
  • You must be 18 years or older.
  • You must meet Australia’s health and character requirements.
  • You must not have had a visa cancelled or a previous application refused while in Australia.

 

For Subclass 801 (Permanent Partner Visa)

To be considered for the permanent Partner Visa (Subclass 801), you must:

  • Hold a valid Subclass 820 visa
  • Continue to be in a genuine and ongoing relationship with your sponsor
  • Meet the relationship requirements at the time of the 801 assessment
  • Continue to meet all health, character, and sponsorship conditions

Subclass 820 and 801 Partner Visa Costs

When applying for a Partner Visa (Subclass 820 and 801), there are two main types of costs to consider: the professional service fees for preparing your application, and the visa application charge set by the Department of Home Affairs.
