The Administrative Review Tribunal (ART) exists to provide an independent review of decisions made by Australian Government agencies, departments, and ministers. If you have received a decision that you believe is incorrect, unfair, or unreasonable, the ART may be able to reconsider your case and ensure that justice is served.
What types of decisions can the ART review?
Visas: The ART can review a range of visa-related decisions made by the Department of Home Affairs, the Minister for Home Affairs, or the Minister for Immigration. However, it is important to note that not every type of visa decision can be reviewed, so you should always check your decision letter to confirm whether ART review is available.
The Migration Division of the ART operates as a non-adversarial tribunal to review decisions made by the Department of Home Affairs. Applicants may be represented by a registered migration agent or immigration lawyer. In most cases, the Department does not appear as a party or have legal representation at the hearing, and the Tribunal Member independently conducts the review based on the evidence before it.
Centrelink: If you have a dispute with Centrelink about your payment, allowance, or benefit, the ART may be able to review the matter. Before this happens, however, your case must first be reviewed by an Authorised Review Officer within Centrelink.
NDIS: The ART also reviews specific decisions made by the National Disability Insurance Agency (NDIA) under the National Disability Insurance Scheme Act 2013. This includes issues relating to eligibility, supports funded in your plan, or the type and level of assistance approved.
Child Support: If you disagree with a child support decision, you can request ART review once the matter has first been reconsidered by a Child Support Objections Officer.
Taxation: The ART may also review certain decisions issued by the Australian Taxation Office (ATO). Typically, the decision letter will clearly state whether or not you have the right to seek a review through the ART.
Workers’ Compensation and Entitlements: The ART can consider appeals relating to Commonwealth workers’ compensation, veterans’ entitlements, and military compensation matters, ensuring that individuals receive the benefits and recognition they are entitled to under the law.
Other Matters: Beyond these areas, the ART also has the authority to review some decisions made under Norfolk Island laws as well as decisions made by certain state or non-government bodies.
