Sponsored by an Australian Employer? Planning to Settle Permanently in Australia?

At Easy Aussie Migration, we specialise in permanent employer-sponsored visas. Our principal agent, Roy, has extensive experience working with the Department of Home Affairs and top immigration law firms. This equips us with deep insight into ENS visa eligibility, employer nomination requirements, and documentation, ensuring a smooth, compliant application process.

About the Subclass 186 Employer Nomination Scheme Visa

The Subclass 186 ENS Visa offers skilled workers the opportunity to live and work permanently in Australia through employer sponsorship. This visa has two main streams:

  • Temporary Residence Transition Stream: For workers who have held a Subclass 482 Temporary Skill Shortage visa for at least 2 years within the last 3 years immediately before the application for the visa is made. Your employer must be willing to sponsor you further and continue employing you in the same occupation on a long-term basis.
  • Direct Entry Stream: For skilled workers applying without prior employment with the sponsoring employer or those applying from overseas provided your occupation is listed on the relevant skilled occupation list, you meet the employment requirements and have an employer who is willing to hire you and sponsor you.

The ENS visa requires nomination by an approved Australian employer and a skilled occupation listed on the Medium and Long-term Strategic Skills List (MLTSSL). This visa grants permanent residency status, opening the door to an Australian permanent future.

Eligibility Requirements for the Subclass 186 Employer Nomination Scheme Visa

To be eligible for the Subclass 186 ENS visa, applicants must meet several important criteria set by the Australian Government. While the full details are available on the Department of Home Affairs website, here’s a simple summary:

  • You must hold a valid passport.
  • You need to be sponsored by an approved Australian employer. If you’re applying through the Temporary Residence Transition stream, the job you’re applying for must be the same as the one you worked in while on your TSS visa.
  • For the Temporary Residence Transition stream, you must have worked full-time for your sponsoring employer for at least two years while holding your TSS visa.
  • For the Direct Entry stream, you must have a positive skills assessment from the relevant assessing authority and at least three years of relevant work experience.
  • You must have all the necessary qualifications, registrations, and licences required for your occupation.
  • You generally need to be under 45 years old (there are some exceptions).
  • You must meet the English language requirements set for the visa.
  • You must satisfy health and character checks to ensure you meet Australia’s standards.
  • The Department will also review your visa history, including any current visas or past visa cancellations.

If you’re unsure whether you meet these requirements, consulting with a registered Australian Migration Agent can help you assess your eligibility and guide you through the process.

Benefits of Holding a Subclass 186 Employer Nomination Scheme Visa

  • Permanent Residency: Live, work, and study in Australia permanently with full access to legal rights and entitlements. The 186 visa gives you the security of long-term residence without the need to renew your visa.
  • Access to Healthcare and Social Support: As a permanent resident, you are eligible for Medicare, Australia’s public healthcare system, and may qualify for certain social services and support.
  • Family Sponsorship: You can sponsor eligible family members for permanent visas, allowing your loved ones to join you and enjoy life in Australia.
  • Travel Rights: Travel freely in and out of Australia for five years from the date your visa is granted. After that period, you can apply for a Resident Return Visa to maintain your travel rights.
  • Pathway to Citizenship: After meeting residency and other eligibility requirements, you may apply for Australian citizenship, giving you full legal rights as an Australian.
  • Workplace Rights and Protections: As a permanent resident, you’re entitled to full workplace protections under Australian law, including fair wages, safe working conditions, and legal recourse if needed.

Subclass 186 Employer Nomination Scheme Visa Checklist

When applying for a Subclass 186 (ENS) visa, submitting the visa application form alone is not enough. The Department of Home Affairs requires a range of supporting documents to assess your eligibility based on the specific stream you’re applying under whether it’s the Temporary Residence Transition (TRT) stream or the Direct Entry (DE) stream.

Applicants must provide evidence tailored to their circumstances. While requirements can vary on a case-by-case basis, the following checklist outlines the key documents typically required to support your application:

Identity Documents:

  • Valid passport
  • Marriage/divorce/death certificates (if applicable)
  • Proof of name change (if applicable)
  • Passport photos

Skills and Experience:

  • Current CV or resume
  • Relevant qualifications and licences
  • Positive skills assessment (Direct Entry stream only)
  • Employer references and work experience evidence

Employer Nomination Documents:

  • Employer nomination approval letter
  • Signed employment contract
  • Position description and salary details
  • Evidence of Skilling Australians Fund payment

Additional Documents:

  • Police clearance certificates
  • English language test results or exemptions
  • Health examination reports

A well-organised and complete application can significantly reduce processing times and avoid unnecessary delays. At Easy Aussie Migration, our team helps ensure every document is accurate, relevant, and submitted in line with current migration law, maximising your chances of a smooth and successful visa outcome.
